  Lloyd LJ reviewed the other authorities in which the Lyus constructive trust had been discussed (noting that HHJ Cowell had been junior counsel in one important such case, Ashburn Anstalt v Arnold [1989] Ch 1).Here there was no specific identification of Mr Chaudhary’s right, merely the general stipulation in the Standard Conditions of Sale that the property was sold subject to incumbrances which were are discoverable by inspection of the property before the contract. Arnold LJ adopted a different interpretation of Case C-98/13 Blomqvist v Rolex SA than the trial judge in reaching this conclusion.Permission for Amazon to appeal to the UK Supreme Court was refused by Arnold LJ in a subsequent judgment on form of order.Targeting is a tricky doctrine. [read post]
