So, on to MA Lloyd & Son Ltd v PPC International Ld (t/a Professional Powercraft) [2016] EWHC 2162 (QB) in which we find PPC seeking wasted costs orders against Roderick McCarthy, following the usual spectacularly bad and incompetent litigation against PPC by Charles Henry ‘acting’ for MA Lloyd – in this instance, 3 failed claims, multiple failed appeals of orders and unpaid costs orders at the time MA became insolvent. After a lengthy trek through Bubb, Puhlhofer, Cocks v Thanet District Council [1983] 2 AC 286, Ferdous Begum and R v Northavon District Council ex parte Palmer (1994) 26 HLR 572, the court concluded that Wednesbury was the appropriate test and further that “the range of rational decisions” was not so narrow as to determine the outcome.
