The Supreme Court of Ohio ruled today that when an injured worker who qualifies for an award of permanent total disability (PTD) contracts to receive a partial lump-sum advancement of state workers’ compensation benefits to be offset by deductions from future weekly benefit checks, and the claimant later alleges that the state has wrongfully continued to withhold funds after it has recovered the full value of the lump-sum advancement, that claim is for money damages… [read post]
