I conclude that the courts should continue to develop "fair circumvention" exceptions to the DMCA, but should do so (1) explicitly, and (2) based, at least initially, on criteria drawn from existing copyright principles of fair use. [read post]

  This is important to most content owners because:  (1) copyright law protects expression, and generally affords little, if any, protection to factual information (though it still protects the expression of factual information), (2) even when expression is unlawfully reproduced,  the fair use doctrine may protect certain uses of the expression.
