Whilst it is not hard to see why both sides asked the Court to proceed on this assumption, it seems that this is not necessarily a correct assumption and indeed before the referendum, two senior figures (Sir David Edward – a former CJEU judge and Professor Derrick Wyatt QC – a leading constitutional lawyer at the University of Oxford) opined that this was not so and that it was possible for the UK to pull out of pulling out, so to speak.
