Many questions remain.Today this rule basically covers COLLECTING DNA but I see nothing in the rule that prevents lawmakers -in the future- from doing anything they want with the CODIS data base where all DNA information is stored.This is a complicated proposed rule and honestly I don't have answers to many questions that my own mind conjures up. And if the threat to privacy wasn't enough, the irony slays us: the sheer volume of DNA samples and profiles to be collected and uploaded to CODIS — projected at more than 1 million per year once these new rules take effect — will create a massive backlog in the system, as it takes several manhours just to turn a DNA sample into a usable DNA profile. Since its implementation, CODIS identified a possible match (not necessarily a defendant) in 2,238 total investigations as of March 2008, and in 50,000 investigations nationwide.Three states allow the defense bar access to CODIS, which would certainly make it easier to check innocence claims or pursue independent investigatory paths from police.A couple of speakers emphasized that scientists don't actually "match" DNA, but estimate a statistical probability… [read post]
