The technical board of appeal (TBA) ruled that whilst there were essential differences between the mouse and human skin, mouse experiments would have “provided a basis for possible future experiments with human beings", the problem and solution being the same.By contrast, in T 0986/02, the TBA held that a claim directed to the use of a composition to treat systemic lupus erythematosus (SLE) was non-obvious in view of mouse data in the prior art.
