Unfortunately for Microsoft, this definition was never brought up at trial and therefore, following Conoco Inc v Energy & Envtl, Int'l L.L.C. (2006), the Court held that Microsoft hadwaived their right to present new claim construction arguments: their motion in respect of this and infringement by the doctrine of equivalents was thus denied.
