One thing to note is that this proposal includes a risk of harm analyis (ROHA) which leads me to believe that the ROHA currently in HHS' HITECH Interim Final Rule on Breach Notification is like to stay in the final rule, despite all the controversy surrounding it (e.g. all the push back from consumer groups that this essentially lets the healthcare industry off the hook). Specifically, the Court held that the Secretary of HHS was authorized to employ statistical sampling and extrapolation as set forth in Health Care Financing Administration (HCFA, now known as CMS) Ruling 86-1 since the Medicare Act did not prohibit statistical sampling and such a procedure was consistent with the Secretary's duty to prevent overpayments.
