I don't know much about the judiciary up in El Dorado county, but this is most definitely not a good look.It was bad enough when I read the beginning of the case, in which a former trial judge becomes a lawyer on a matter in which he participated personally and substantially as a judge (notwithstanding the express ethical rule that says you can't do that). It wasn't a very good end of the week -- or end of the month -- for appellant's counsel in this case, as they (1) see their appeal get dismissed with a (rare) summary affirmance by the Ninth Circuit, plus (2) receive an order to show cause why they shouldn't be sanctioned for a frivolous appeal.   That's a darn good point, and it's one that I didn't sufficiently appreciate until I was reminded of it by Judge Clifton's dissent.One can summarize Judge Clifton's dissent by saying that there was sufficient evidence here for a reasonable jury to find that the police officer deliberately shot the unarmed decedent in the head at point-blank range when the vehicle the decedent was driving was travelling four miles an hour.   That may be good enough for ordinary motions, but not motions for summary judgment.P.S. - I'm not entirely sure what type of lawyer wants to jump into a meritless case that the plaintiff has unsuccessfully (and repeatedly) litigated below pro se. [read post]
