Sure, all these things are part of the package, but they fall increasingly short of what the Supreme Court needs if we’re to have decisions that work in the trenches because they aren’t elitist fantasies of the law, but at the same time aren’t simplistic solutions that will destroy the fabric of the law and constitutional rights for decades, if not centuries, to come.
