I'm not entirely sure that intermediate scrutiny, rather than strict, should apply, and I'm not entirely sure the government is entitled to a remand having failed to make their case the first time around, but the opinion makes a plausible case, and I can see why this seemed like the most practical way to resolve the case.A few additional thoughts:1:  This is a very long opinion for Judge Sykes.
