ICC Jurisdiction Sudan is not an ICC State Party, but the UN Security Council referred the situation in Darfur to the Court in 2005, thereby triggering the latter’s jurisdiction (via article 13(b) of the ICC Statute) and avoiding the ordinary imperative to establish that the relevant crimes either occurred on State Party territory or were perpetrated by State Party nationals.
