So, Google Book Search is freeing itself from the constraints of a gazillion billion dollars worth of lawsuits and walking off into the bright sunshine of ‘tomorrow’s another day,’ arm and arm with the publishers and authors who still disagree with it about whether Google’s original plan was fair use, but hey, that plan is so 2004. As to other issues, such as state trademark issues, the First finds that the First Amendment issues are so vibrant that even without Sec. 230 immunity, they would fail, because the defamation claims were not really trademark claims under Florida (or any) law, and even if they were, those talking smack about a company comes under fair use. The 9th circuit found that the thumbnails were fair use, at least absent a specific showing that their economic impact on the owner's business---a porn website which also delivered low-res pics to cell phones---outweighed the transformative nature of the thumbnails when used as part of the image search on a conventional computer. Perfect 10, an Internet pornography company, had filed suit against Google alleging that Google’s generation of thumbnails based on illegal copies of Perfect 10s images was illegal however, the lower and Appeals court both ruled in Google’s favor, claiming that the use was a fair use. [read post]
