In Irish law, children’s interests are currently protected by constitutional rights to welfare under Article 42 and Article 40.3 (identified in cases such as G v An Bord Uchtála and Nicolaou v An Bord Uchtála) and the requirement under section 3 of the Guardianship of Infants Act, that the court must make the child’s welfare the first and paramount concern in cases involving the child’s upbringing.
