However The case of Sheffield City Council v Hopkins [2001] EWCA Civ 1023 is clear authority for the proposition that on an application for suspension of a possession warrant where the order has been made on the grounds of rent arrears the court is entitled to have regard to other breaches of the tenancy agreement or other established grounds for possession in deciding whether or not to exercise its discretion to allow any or any further suspension. We couldn't finish the case, and will go back to do so, but two points struck me; firstly that a great deal of money is at stake if we uphold the Council's decision, and secondly that one of the cases we shall have to have regard to is Hope & Glory Public House Ltd v City of Westminster Magistrates' Court.
