With the world’s leading economies in recession, 2009 saw an increase of 20% on the previous year in claims initiated in the London Commercial Court.1 1,225 claim forms were issued, close to the average in the early years of the last decade, and the highest number since 2002.2 More striking still, cases submitted to the London Court of International Arbitration reached a record high in 2009, an annual increase of almost 30%.3 Many of these claims are likely to have foreign elements.
