  One could argue that we should “channel” various disputes into TM instead of false advertising, but I’m not sure why in this case, though an implicit theory requiring fault rather than error—not usually a requirement in false advertising cases, but implied in Lanham Act false advertising cases brought on the basis of false patent claims—might explain what the court does.
