I'll just point out that, in New York, the relevant statute is § 12.01 of the Arts & Cultural Affairs Law, which provides that, when an artist consigns work to a dealer, the work is considered "trust property" in the hands of the dealer for the artist's benefit and, likewise, any sales proceeds are held as "trust funds" for the artist.
