It was a (relatively) light Patent Trial and Appeals Board (PTAB) and district court week, with 26 PTAB (two post grant reviews and 24 inter partes reviews) and 48 new district court complaints, with the number of dismissals or closed cases in district court again reaching nearly 100 for the third week in a row—I’m unsure exactly, though I suspect it has something to do with a fair number of cases being voluntarily dismissed and refiled in other jurisdictions following renewed… [read post]

A normal week at the Patent Trial and Appeal Board and a heavy week in the district courts saw 100 new patent complaints filed and 30 petitions before the Board; there were 79 district court terminations as well, as cases settled quickly and a number of withdrawals or refilings continue in and out of the Western District of Texas. But the Federal Circuit found that Judge Albright had not clearly abused his discretion.The standard of review in a mandamus matter (somewhat similar to an interlocutory appeal) is that there must be a "clear and indisputable" right to relief, which in a venue transfer case means (if there is no clear error) a clear abuse of discretion.
