That seems consistent with the Appellate Body jurisprudence: in Shrimp/Turtle held in paragraph 121 that Article XX, including Article XX(a), does not exclude, in principle, measures that condition imports on conduct that occurs outside the territory of the regulating Member, including the policies of other Members.
