Many people deserve congratulations, but special kudos are due to Massachusetts Assistant Attorney General Jim Milkey for his terrific oral argument, Georgetown University Law Professor Lisa Heinzerling for the magnificent briefing (with assists from many others), and the 19 groups led by the International Center for Technology Assessment that had the prescience to file the original rulemaking petition with EPA back in 1999. My judgment has been that, pedagogically, it makes sense to incorporate more on the regulatory state than is typical in a basic administrative law course, and I'd guess that over the first years of implementing the Harvard curriculum there will be movement in that direction, even if not quite as far as Lisa Heinzerling and I have gone in our coursebook.I doubt that anyone thinks that this curricular revision is equivalent to the adoption of the case method by Christopher… [read post]
