We analogize in that brief to speech restrictions, where First Amendment law must decides what's a restriction on speech and what on constitutionally unprotected conduct: A town, for instance, can't ban live performances, newspapers, or photographers, or limit their number; but the First Amendment doesn't stop it from banning or limiting hotels, caterers, limousine drivers, bakers, florists, and the like.
