Even had Louboutin managed to get past the first and second hurdles of the test (the court did not consider the first hurdle re irreparable harm because Louboutin did not demonstrate that its red sole mark merited protection) it would have been a pretty tall task to try and come up with a form of an injunction that prevented the alleged harm without being overly broad.
