 As keen readers will be well aware by now, the CJEU departed slightly from this position finding that if a person provides such a link, this will not be a “communication to the public” provided that (1) the link is provided without the pursuit of financial gain; and (2) the person did not know, or could not reasonably have known, the illegal nature of the publication of those works.
