Bureau of Land Management (collectively, BLM) violated the National Environmental Policy Act (NEPA), the Federal Land Policy and Management Act (FLPMA), and its own regulations, by permitting Denison Mines Corp. and Denison Arizona Strip, LLC (collectively, Denison) to restart mining operations at the Arizona 1 Mine in 2009, after a seventeen-year hiatus, under a plan of operations that BLM approved in 1988. In the House bill, we were most concerned about sections that would allow importation of polar bear trophies taken in sport hunts in Canada, even though polar bears are listed as a “threatened” species under the Endangered Species Act; that would open nearly all federal public lands to sport hunting; and that would strip the Environmental Protection Agency of its ability to protect the public and environment from toxic lead through ammunition exposure.
