  In Kawa, Erie County Supreme Court Justice Thomas Flaherty agreed with  my argument and held that the parties' dispute over whether the policyholder's wind-damaged siding needed to be completely  replaced or could be repaired was essentially a coverage dispute rather than one simply involving the amount or value of the loss and was therefore not amenable to the policy's appraisal condition.
