Finding that a trial court did not err in submitting to the jury the question of whether an employee was a “qualified individual with a disability” as a predicate to a finding of discrimination, the Fifth Circuit rejected an employee’s claim that the ADAAA eliminated the need to prove a disability before reaching the question of whether a termination was discriminatory (Neely v PSEG Texas, LP, November 6, 2013, Smith, J).
