Although one can never know the jury’s mind for certain, the high likelihood is that the jury acquitted on the Rule 10b-5 charges because the trial court charged it that a “personal benefit” to the tipper only needed to be shown in a Rule 10b-5 case but not in a §1348 securities fraud case (and evidence of such a personal benefit was sorely lacking in Blaszczak).
