Ourselves, and others (mainly John Gregory), have reported and commented on these rules on multiple prior occasions, but as time goes on, the major question surrounding said rules is less and less “what should they say”, and more and more “why bother”. [read post]

From a practical standpoint, it’s hard to imagine four justices granting cert: Justices Ginsburg and Sotomayor would seem to sympathize with Judge Gregory’s race-based perspective of U.S. law, and Justices Roberts and Alito tend to adopt reflexively pro-government positions on criminal justices issues.
