I'm going to presume that most of my readers are familiar with motions to dismiss, and so will not dwell on the court's discussion of Iqbal (which discusses the "plausibility" requirement in federal pleading) or Rule 9(b) (which requires a heightened pleading standard for fraud-based claims). The problem is that the inevitability of factual, legal, and moral error gives us a system that we know must wrongly kill some defendants, a system that fails to deliver the fair, consistent, and reliable sentences of death required by the Constitution.I'm laboring this because it points toward one of the two reasons why the book is annoying.
