 The government's argument as I understand it:  Although the SCOTUS appeal involved different parties and a discrete issue that will not be part of the executive's or AU's appeal (the enforceability of the subpoena), the SCOTUS appeal is incidental to the  the criminal prosecution of both and therefore the appeals of the conviction.
