If a state’s consent to federal acquisition of lands in Article I, Section 8 is not “lawmaking” (as Justice Ginsburg implies it is not), but rather “consenting” (akin to Article V amendment ratification) which must be done by the elected state legislature, the same is very likely true for “consent” to giving up lands to create new states.
