The EUTM Regulation is relevant for all UK businesses wanting to apply for a EUTM, provided that they have a place of business, a real and effective establishment, or a domicile in the EU, or they have appointed a representative for all proceedings before the EU Intellectual Property Office (EUIPO).The EUTM Implementing Regulation lists a number of marks and ways to represent them, including non-conventional marks such as holograms and sounds (art 3(3)(a)-(j)).
