To be precise, the attorney general’s brief stated that “the Commonwealth does not oppose a narrowly drawn declaratory judgment stating that, as applied to these plaintiffs, §§ 131(d)(i)(e) and 131A infringe the Second Amendment right to possess firearms in the home for self-defense” (emphasis added), but in this context this sort of “no contest” position is essentially an admission that the ban violates the Second Amendment as applied.
