Pangloss is less keen on this argument than her own resting on Art 7(f) of the DPD, (surprise), partly because the Art 8 ECHR law is in such flux and partly because it reinforces the data protection equivalent case of Durant which many DP commentators feel was wrongly decided. but it's a good piece : read it.
