Para 159, to the extent it notes that restitution is “frequently based upon the theory of unjust enrichment”, is undoubtedly correct, but it may not be accurate to suggest that there “can be no restitution without unjust enrichment”, for the law does recognise restitution for wrongs (Attorney General v Blake).
