Along with the Center for Democracy & Technology (CDT), we recently filed two friend-of-the-court briefs on behalf of ourselves, CDT, and a number of LGBTQ+, sex worker, and startup advocacy organizations arguing that courts should not interpret the law in this way, because doing so would incentivize online intermediaries to censor more online speech — especially materials about sex, youth health, LGBTQ+ identity, and other important concerns. While the final text of ACTA deleted or softened many of the more troubling provisions, CDT remains concerned that it reflects a general trend of trying to use trade negotiations to promote a selective vision of copyright law -- one with strong and mandatory enforcement provisions, but weak and purely optional limitations and exceptions. Recognizing that the fight may not be over, Pakistani NGO Bolo Bhi brought together CDT, Access Now, ARTICLE 19, EFF, Citizen Lab, Global Voices Advocacy, Index on Censorship, and Reporters Without Borders to sign a letter urging the Pakistani government to stand up for free expression and economic growth and officially put this plan to rest.
