It's all about the use and misuse of so-called "similar occurrence" evidence in the trial of product liability litigation.Everybody who defends drug and device manufacturers in product liability cases knows all too well how much plaintiffs love to wave ADEs around in front of juries as "evidence" that the defendant knew all along that its drug/medical device/vaccine caused whatever injury they're claiming this week.
