1 There is a canard that Justice Scalia allegedly seeks the “original intent” of constitutionally-based guarantees — well, I suppose it’s not totally baseless, since it’s based on Scalia’s saying that’s what he does, even though he doesn’t — but, at any rate, that won’t help here for two reasons.
