I’m not going to set it all out here but the core part (from section 1) is this : (3) Behaviour is “abusive” if it consists of any of the following— (a) physical or sexual abuse; (b) violent or threatening behaviour; (c) controlling or coercive behaviour; (d) economic abuse (see subsection (4)); (e) psychological, emotional or other abuse; and it does not matter whether the behaviour consists of a single incident or a course of conduct. CPR 55.8 provides (1) At the hearing fixed in accordance with rule 55.5(1) or at any adjournment of that hearing, the court may – (a) decide the claim; or (b) give case management directions. (2) Where the claim is genuinely disputed on grounds which appear to be substantial, case management directions given under paragraph (1)(b) will include the allocation of the claim to a track or directions to enable it to be allocated.
