 While I have never had this exact situation arise at trial, I doubt a family court judge court could award the house to the other party at a value of $250,000.00 when my client has testified as to a willingness to keep the home at a value of $275,000.00 (the court could certainly justify awarding the home to either party at a value of $275,000.00, so one must be careful in the valuation that one's client places on an asset).
