Blaisdell,[5] Chief Justice Hughes mentioned that courts “set aside” unconstitutional statutes.[6] Unconstitutional statutory rules are legally inoperative, and courts disregard them in deciding cases.[7] That use of “set aside” fits the context in which section 706(2) appears. [read post]
