In Lange v Atkinson [2000] 3 NZLR 385 the Court of Appeal criticized and declined to follow Reynolds, for the reason that they had altered “the structure of the law of qualified privilege in a way which adds to the uncertainty and chilling effect almost inevitably present in this area of the law”.
