This issue was explored by the Court of Appeal in KU v Liverpool City Council [2005] EWCA Civ 475, where it was determined that a Court did not have the power to award different success fees for different periods in a claim where the CFA itself did not provide for the same:"The approach of the district judge negates the whole purpose of assessing at the outset the risks involved in pursuing a claim.
