So, if I bring a claim on an oil and gas lease that involves some performance in Virginia and some in Kentucky (as I have done, in fact) in Virginia court and the Virginia court rules the claim is time-barred under the relatively short five-year Virginia statute of limitations for claims on a written contract, I can pack up and refile in Kentucky where the contract limitations used to be 10 years and nothing that happened in Virginia will be res judicata, because it was not… [read post]
