Scripps-Howard Broadcasting Co., the Supreme Court held that an unusually narrow state "right of publicity" claim didn't violate the First Amendment, but repeatedly stressed that "[p]etitioner does not merely assert that some general use, such as advertising, was made of his name or likeness; he relies on the much narrower claim that respondent televised an entire act that he ordinarily gets paid to perform.
