If any one defendant was found to be 60% or more responsible for the happening of an accident, then that defendant would be responsible to pay the entire verdict (and to, thereafter, be able seek a reimbursement of its overpayment from any other responsible co-defendant).There are also other express exceptions written into the Fair Share Act by the legislature as well, including an exception in cases involving dram shop claims, to name another one.
