The Supreme Court of Pennsylvania vacated the Superior Court’s ruling and remanded the case back to the Superior Court for reconsideration.[11]  Perhaps most importantly, the Supreme Court rejected the Superior Court’s suggestion that the rule of capture does not apply to hydraulic fracturing due to the fact that hydraulic fracturing is an artificial means to stimulate production.
