If you run ends and means together in this way, you effectively read the Necessary and Proper Clause out of the Constitution and invalidate quite a lot of what the federal government now routinely does.Now, it has been clear for some time that the most articulate opponents of the mandate (who include such formidable intellects as Richard Epstein, Randy Barnett, and Gary Lawson) have just this in mind. The fact that I disagree strongly with repealing the Seventeenth Amendment or adopting Randy Barnett's "Repeal Amendment" (though for reasons that might surprise some of you) is not at all the same thing as adopting the rhetoric of our "basically perfectly Constitution" that is the motif of too much of the response to Tea Party proposals. Elie Mystal’s description is outrageously hyperbolic, to the point of arguing about how Nazis shouldn’t have First Amendment rights, and yet not nearly as irrational as Joe Patrice’s “blow-by-blow” of how the invitation-only speech was limited to those invited, which proves they’re all snowflakes and Georgetown lawprof Randy Barnett is a Sessions lackey.
